The Supreme Court today dismissed the petition of Retired Justice Dharma Vir Sharma, a member of the three-judge of the Allahabad High Court bench which had delivered the landmark Ayodhya verdict on September 30, 2010, challenging his non-appointment in the National Green Tribunal.
A bench of Justices Altamas Kabir and SS Nijjar said Sharma cannot claim any right to appointment as it was the prerogative of the government.
The bench told counsel N Gupta appearing for the Former Judge that this is not a post and therefore does the court has the power to give any such directions and a writ of Mandamus.
Gupta urged that Sharma was selected both for National Green Tribunal and Central Administrative Tribunal by the high-powered committee but he was not appointed and also said that they did not put forth any reason for his non-inclusion.
However the argument failed to convince the bench which said the petitioner has no right to appointment and dismissed the petition.
Justice Sharma was a member of the three-bench judges which had ruled by a majority verdict that the disputed land in Ayodhya will be divided equally into three parts among Hindus, Muslims and and that place, where a temple of Lord Rama exists, which belongs to the Hindus.
