The Delhi High Court today seeked the CBI's opinion on granting bail to the former Telecom Secretary Siddharth Behura who was arrested for his alleged role in the 2G spectrum case. While issuing a notice to the CBI by Justice Shali, it also asked the CBI to file a status report by December 1, the date on which the bail pleas of the other five accused in the case including DMK MP Kanimozhi are scheduled for hearing.
Senior counsel Aman Lekhi appeared for Behura in the High Court challenging the denial of his bail by the Special CBI wing which had refused him relief on the ground that the charges levelled against him and other accused were of very serious in nature.
Behura, in his bail application, pleaded to the honorable court that the trial of the case had already begun with and there cannot be any fear of tampering of the evidence or influencing witnesses by him.
He also said the Apex Court earlier, while refusing bail to Kanimozhi, had asked the accused to approach the court for bail after charges were framed in the case.
The trial court had dismissed Behrua's bail plea on November 3.
Behura, along with the former Telecom Minister A Raja and the latter's private secretary R.K. Chandolia was arrested on February 2, this year.
Besides Behura and Kanimozhi, the other four accused who has approached the High Court against the special courts order denying the bail plea are DMK-run Kalaignar TV MD Sharad Kumar, Kusegaon Fruits and Vegetables Pvt Ltd, Directors Asif Balwa and Rajeev Agarwal and Bollywood producer Karim Morani.
